Criminal prosecution

In Ukraine (2012)

On January 26, 2012, the Ukrainian prosecutor's office opened a criminal case against Arsen Avakov under Art. 365 of the Criminal Code of Ukraine on the fact of malicious abuse of power and official authority, leading to grave consequences, specifically for the illegal change of purpose and transfer to private ownership of 55 hectares of state land worth over 5.5 million hryvnia in Pesochin. On January 31, his apartments were searched. The reason for initiating a criminal case was discovered during the inventory of the Kharkov branch of the State Land Committee at the end of 2011, although a similar procedure at the end of 2010 did not reveal the land transfer act that existed at that time.

Since Avakov had been in Europe since the fall of 2011, on January 31, 2012, he was put on the international wanted list by Interpol. On June 21, 2014, the Investigative Committee of the Russian Federation opened a criminal case against Arsen Avakov and the head of the Dnepropetrovsk regional administration Igor Kolomoisky, accusing them of organizing murders, using prohibited means and methods of warfare, obstructing the professional activities of journalists and kidnapping during an armed confrontation in the east Ukraine. Avakov called the criminal prosecution in Russia a “high appreciation” of the work he has done, promising to continue “to be as inconvenient as possible for the Putin regime.”

As part of this case, the Russian Investigative Committee, according to a number of media reports, began to massively interrogate all Ukrainian citizens in the Russian Federation. On March 26, 2006, he was elected as a deputy of the Kharkov Regional Council of the V convocation, a member of the commission on budget issues. On April 11, 2009, at the proposal of the leader of the All-Ukrainian public movement "For Ukraine!” Vyacheslav Kirilenko was elected chairman of the Kharkov regional organization “For Ukraine!”

On February 3, 2010, an extraordinary session of the Kharkov Regional Council passed a vote of no confidence in Avakov as the head of the region with the wording “for the use of administrative resources during the preparation for the second round of presidential elections” (Newspaper “Time of Kharkiv Regions” No. 6(209), 2010, p.2 ).

On February 5, Ukrainian President Viktor Yushchenko dismissed Avakov from his post on the basis of Part 10 of Art. 118 of the Constitution of Ukraine, which states that if two-thirds or more of the deputies of the council at the appropriate level express no confidence in the chairman of a district or regional state administration, the president decides to resign the chairman of the state administration.

On February 9, 2010, two days after Viktor Yanukovych’s victory in the presidential elections, he resigned from the post of chairman of the Kharkov Regional State Administration in accordance with Part 3 of Art. 31 of the Law of Ukraine on Civil Service “fundamental disagreement with the decision of a government body or official, as well as ethical obstacles to being in the public service,” stating that he has not yet received a presidential decree on his resignation and does not want to take part in this soap opera opera, although until that moment he considered the presidential decree illegal.

Since the fall of 2011, Avakov has been in Europe on business with his own foundation, in particular promoting the film “The Armenian Heritage of Europe.” Until December 2012, he was in exile in Italy due to criminal prosecution in Ukraine.

During the political crisis in Ukraine in 2013-2014, the Verkhovna Rada of Ukraine on February 22, 2014 dismissed the acting. Minister of Internal Affairs Vitaly Zakharchenko and appointed Arsen Avakov as acting. Death of "Sashka Bilyo" and accusations of the "Right Sector"

On the night of March 24-25, Alexander Muzychko was killed during police detention in the Rivne region. "Right Sector" accused the Minister of Internal Affairs of Ukraine Arsen Avakov of the murder of Muzychko and promised to take revenge on him.

In response, Avakov said: “If some bandits threaten the minister, I accept this challenge and am ready to accept any challenge.”

On the evening of March 27, 2014, Right Sector activists stormed the Verkhovna Rada of Ukraine demanding Avakov’s resignation.

Based on the results of 100 days of work as minister, Avakov named among his main achievements the prevention of a separatist scenario in Kharkov, the re-establishment of the National Guard and the successful work of the police during the presidential elections. At the same time, he admitted that under the current conditions it was not possible to carry out reform of the Ministry of Internal Affairs.

On July 29, the head of the Ministry of Internal Affairs announced the department’s plans to replace about 20 thousand police officers in the Lugansk and Donetsk regions who discredited themselves during recent events in these regions.

On August 19, Arsen Avakov signed an order on joint actions of the Ministry of Internal Affairs and the National Council on Television and Radio Broadcasting to monitor compliance with legislation in the field of a temporary ban on broadcasting Russian television channels that promote war and violence in the country. Territorial divisions of the Ministry of Internal Affairs will help identify cable operators who do not comply with the decision to stop broadcasting banned Russian TV channels on the territory of Ukraine, as well as monitor their broadcast on internal cable networks in public buildings.

On August 26, Arsen Avakov announced that he would not participate in the parliamentary elections together with the Batkivshchyna party, about 20 people left the political council with him, among them: Alexander Turchynov, Arseniy Yatsenyuk, Sergei Pashinsky, Andrey Parubiy, Pavel Petrenko , Liliya Grinevich.

The reason, according to the head of the Ministry of Internal Affairs, was that they were unable to agree with the party on a merger with several other political forces and put the current Prime Minister Arseniy Yatsenyuk at the head of the list.

A new political party was created by re-registering an existing one, its name is “Popular Front”.

On September 10, Arsen Avakov joined the military council of this party, created in accordance with Ukrainian legislation, according to which military personnel and law enforcement officers cannot be members of any party.

At the end of August 2014, Arsen Avakov announced a plan to submit a draft reform of the Ministry of Internal Affairs by September 15, and which is planned to be adopted by the Cabinet of Ministers and Parliament by the end of October. The project itself is almost ready, and the remaining details will be finalized by the specified deadline.

Political persecution

In January 2012, according to the website of the Kharkov Regional State Administration, the prosecutor's office of the Kharkov region carried out an investigation into the appeal of the Kharkov Regional State Administration dated January 3, 2012 about the illegal actions of the former head of the regional state administration Avakov when signing and issuing state acts on ownership of land plots to one of the limited liability companies.

Based on the results of an inspection by the regional prosecutor's office, a criminal case was opened against officials of the regional state administration and the Main Directorate of the State Committee for Land Resources in the Kharkov region on the fact of illegal alienation of state-owned land during 2009 through abuse of official position, which entailed grave consequences, and on the fact of official forgery on the grounds of a crime provided for Part 2 of Article 364, Part 2 of Article 366 of the Criminal Code of Ukraine.

The pre-trial investigation in a criminal case was entrusted to the department for investigating criminal cases of crimes related to corruption of the Kharkov region prosecutor's office and was taken under control by the leadership of the regional prosecutor's office.

According to information from the head of the Main Legal Department of the regional state administration, Konstantin Prokopiev, due to illegal actions of officials of the regional state administration and the Main Directorate of the State Committee for Land in the Kharkov region in 2009, the designated purpose of state-owned agricultural land with a total area of ​​almost 55 hectares worth over 5.5 million UAH was illegally changed.

The information about the initiation of a criminal case against me was both unexpected and expected for me at the same time. Back in October, the general strategy of officials of the ruling regime in the country became clear to me: to find any reason to deal with me and those around me.

They attacked, opened cases, put people close to me in prison under far-fetched, fabricated reasons. I spoke about this openly on my blog in UP.

The events of the last few months, the initiation of a case directly against me, have confirmed the obviousness of those October lines...

The expected happened. The authorities, seeing increased opposition activity in Kharkov, decided to launch a vulgarly concocted case against me, as one of those who did not accept the lawlessness occurring in the country.

Today I instructed my lawyer to visit the prosecutor’s office of the Kharkov region to familiarize myself with the charges, which are completely unknown and incomprehensible to me. In Russia:

On June 21, 2014, the Investigative Committee of the Russian Federation opened a criminal case against Arsen Avakov and the head of the Dnepropetrovsk regional administration Igor Kolomoisky, accusing them of organizing murders, using prohibited means and methods of warfare, obstructing the professional activities of journalists and kidnapping during the ATO in Donbass Ukraine. Avakov called the criminal prosecution in Russia a “high assessment” of the work he has done, promising to continue “to be as inconvenient as possible for the Putin regime.”

As part of this case, the Russian Investigative Committee, according to a number of media reports, began to massively interrogate all Ukrainian citizens in the Russian Federation. The agency announced the interrogation of only forced refugees and citizens of Ukraine who have relatives in the conflict zone.

On July 9, 2014, the Basmanny District Court of Moscow considered and granted the request of the RF Investigative Committee to select an absentee preventive measure in the form of detention against Arsen Avakov. The trial itself took place in a closed mode from listeners at the request of the prosecutor, because the materials contain personal data of the victims - citizens of Ukraine and the Russian Federation, and the trial against Igor Kolomoisky was also held. However, Avakov enjoys diplomatic immunity.

Criminal case

On January 26, 2012, the prosecutor's office of the Kharkov region opened a criminal case against the former head of the Kharkov regional state administration, chairman of the regional organization of the Batkivshchyna party, Arsen Avakov.
